Going over never stops tracking. - Cancel anytime. The current month isn't refunded. - Your data is yours. We process it only to run your dashboard, and delete it 30 days after the subscription ends. These terms are an agreement between you and DataBull ("we", "us") for DataBull Hosted (the "Service"): the DataBull dashboard and tracking we run for you on our infrastructure. By subscribing or using the Service, you accept these terms. If you're accepting for a company, you confirm you're allowed to bind it. ## 1. The Service We run a DataBull dashboard for you at an address on databull.app, keep it updated, and keep it running on Cloudflare. Your dashboard is set up automatically after your payment, usually within minutes. While the Service is in **beta**, features may change. ## 2. Plans and usage - Your plan includes a number of **events a month** (pageviews, goals and outbound clicks across all your websites) and **unlimited websites**. - If you go over, tracking continues and nothing is lost. We'll tell you, and if you stay over we may ask you to move to a plan that fits. If use is far beyond any plan or harms the Service (for example a flood of bot traffic), we may limit it after telling you. - You can change plan any time. Usage counts reset on the first day of each calendar month (UTC). ## 3. Payment, renewal and cancellation Subscriptions are sold by **Dodo Payments**, our merchant of record, which handles payment, tax and receipts. Your subscription renews every month until you cancel. **Cancel anytime** from the billing page; it stops at the end of the month you've paid for. **The current month isn't refunded**, in whole or in part (see the [Refund Policy](https://databull.app/refunds)). If a payment fails and isn't fixed, or after you cancel, we pause your dashboard and stop tracking. ## 4. Your data Everything your dashboard collects is **your data**. You are the controller and we are your processor: we store and process it only to provide the Service, keep each customer's data in its own database, don't sell or share it, and look at it only when you ask (for example for support) or the law requires it. You're responsible for having the notices and consents your visitors' laws require. After your subscription ends we keep your data for 30 days, so you can come back or ask for an export by email, and then delete it. See the [Privacy Policy](https://databull.app/privacy). ## 5. Acceptable use - Track only websites you own or are allowed to measure, and only in ways their visitors' privacy laws permit. - Don't use the Service to break the law, to attack or overload it, or to resell it as your own hosted analytics. We may suspend a dashboard that breaks these rules, after telling you where we reasonably can. ## 6. Availability and changes We work to keep the Service available and your data safe, but we don't promise it will be uninterrupted or error-free. It depends on Cloudflare and on the payment providers you connect. We may change or improve features; if we ever stop offering the Service, we'll give you at least 30 days' notice and an export of your data. ## 7. No warranty The Service is provided **"as is" and "as available"**, without warranties of any kind, express or implied. Analytics are estimates: ad blockers, privacy settings and networks mean no tool sees every visit. ## 8. Limitation of liability To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim connected with the Service is limited to **what you paid us in the 3 months before the claim**. Where the law doesn't allow these limits, they apply as far as it permits. ## 9. Changes, law and contact We may update these terms; the version on this page, with its date, applies from that date, and we'll email you about material changes. These terms are governed by the laws of India, and courts in India have exclusive jurisdiction, except that you keep any protection the consumer laws of your own country give you.
